Labor Law News : President Obama’s Overtime Rule Blocked By Federal Judge
President Obama’s imminent changes to overtime rules (recently discussed on our blog), which would have raised the minimum salary for an employee to be considered “exempt” (and thus not entitled to overtime) from $23,660 to $47,476, has been blocked by a federal judge.
A nationwide temporary injunction was issued by District Judge Amos Mazzant in Texas. Originally set to take into affect in December, the temporary injunction is unlikely to be settled by January 20, 2017 when President Elect Donald Trump will be sworn into office. Labor Law Advocates are concerned that should the ruling be rejected, employers will continue to commit wage theft against workers. President Obama’s overtime rule was pushed through in part to fight wage theft through misclassifying employees as “exempt” managers, as well as ensuring overtime pay for white collar salaried employees who had previously been denied overtime. Wage theft is rampant, but very easy to fight. So let’s fight it!
